These Terms & Conditions govern the purchase of tickets and reservations with Davey’s Locker Sportfishing Inc., Newport Landing Sportfishing Inc., Freelance Sportfishing Inc., Blackfish Sportfishing, Newport Whalesand Newport Coastal Adventure (collectively referred to as “the Company,” “we,” “our,” or “us”). By booking a reservation or purchasing a ticket, you agree to these Terms & Conditions.

By completing a booking, you consent to receive transactional communications related to your reservation, including confirmations, reminders, and operational updates. If you have opted in, you may also receive marketing communications regarding promotions or affiliated businesses, including Davey’s Locker, Newport Landing, Freelance, Blackfish, Newport WhalesNewport Harbor Boat Rentals, and Newport Coastal Adventure. You may unsubscribe from marketing communications at any time; however, transactional messages related to your reservation may still be sent as necessary.

All sales are final except as outlined in our refund policies below. Purchased items may not be exchanged for other items offered on the website. Refund requests due to inclement weather, natural disasters, or medical emergencies may be submitted for review but are subject to approval at the sole discretion of the Company. Refunds will not be issued for extended wait times, traffic conditions, parking issues, schedule conflicts, late arrival, or failure to attend a scheduled trip.

The Company reserves the right to refuse entry, without refund, to any individual who appears to be under the influence of alcohol or controlled substances, attempts to bring weapons or unsafe items aboard, or is deemed a threat to the safety of guests or crew. Vessel assignments, trip destinations, and schedules are subject to change without notice and are not grounds for a refund. The Company is not responsible for promises or representations made by independent promoters, third-party booking agents, or retailers not directly owned or operated by the Company.

For standard and luxury whale watching cruises, sunset cruises, 3/4 Day, 1/2 Day, and Twilight trips, refund requests must be made at least 48 hours prior to the scheduled departure time to be eligible for a refund, less a 4% processing fee. No refunds will be honored within 48 hours of departure. Blackfish refund requests must be made at least seven days prior to departure to be eligible for a refund minus a 4% processing fee. For overnight and two-day fishing trips, refund or rescheduling requests must be made at least 72 hours prior to departure to be eligible for a refund minus a 4% processing fee. No-shows who fail to provide prior notice will forfeit the full purchase price.

Boat Parade and Holiday Lights Cruise bookings are final sale due to the limited duration and high demand of these events. No refunds will be issued under any circumstance. Reschedule requests may be submitted up to seven days prior to departure and are subject to availability and a minimum of a $5 per ticket rescheduling fee. Requests made within seven days of departure will not be honored.

For private rentals and charters, deposits are non-refundable. In the event of cancellation, the non-refundable deposit will be retained to cover damages incurred due to the loss of the charter or rental. Additional terms may apply as outlined in the contract provided at the time of booking.
